1.1. These terms and conditions (the “Terms”) govern the relationship between users and MIG Media UG (haftungsbeschränkt), a company registered in Berlin, Germany (referred to as “the Operator”), concerning the use of the online platform named EDI Jobs (referred to as “the Platform”).

1.2. The Platform is dedicated to fostering equity, diversity, and inclusion (EDI) within various aspects of professional environments. It offers a range of services aimed at promoting EDI principles and practices in education, employment, and organizational culture.

1.3. By accessing or using the Platform, users agree to be bound by these Terms. If users do not agree with any part of these Terms, they should refrain from using the Platform.

1.4. The Operator reserves the right to amend or modify these Terms at any time without prior notice. Users are encouraged to review the Terms periodically to ensure compliance with the most current version.

2. Services

2.1. The Platform provides a comprehensive range of services aimed at promoting EDI in professional environments, including but not limited to:

  • Education & E-Learning: Providing educational resources on EDI topics.
    • EDI @Work Course & Certificate: Offering specialized video content and certifications focused on implementing EDI principles in the workplace.
    • EDI News: Curating news articles, blog posts, and updates relevant to EDI initiatives and advancements.
    • EDI Calendar: Maintaining a calendar of events related to EDI.
  • Job Board: Facilitating the posting and application of job opportunities that prioritize EDI principles.
    • Sign-in: Allowing users to create accounts and access personalized features.
    • Featured Jobs: Showcasing highlighted job opportunities that prioritize EDI values.
    • Services for Companies: Providing tools and resources to assist organizations in fostering EDI within their workplaces.
    • Services for Candidates: Offering support and guidance to individuals seeking employment opportunities aligned with EDI principles.
  • Publishing: Allowing users to publish articles, events, and job postings related to EDI.
  • AI Text Tools: Providing tools to analyze and improve the inclusivity of written content, including gender-neutral language and CV optimization.
  • Marketing & Branding: Assisting organizations in promoting their commitment to EDI through branding and marketing initiatives.
    • EDI Commitment Badge: Recognizing organizations that demonstrate a strong commitment to EDI principles.
    • Social Media Campaigns: Launching campaigns to raise awareness and promote EDI initiatives across various social media platforms.

2.2. The Operator reserves the right to modify, suspend, or discontinue any aspect of the Platform or its services at any time without prior notice.

3. User Accounts

3.1. Users can choose to create either a company account or a candidate account on the EDI Jobs Platform.

3.2. Company accounts are necessary for employers who want to post job listings and access extra services provided by EDI Jobs.

3.3. When users create an account, whether they’re a company or a candidate, they’ll get their own profile. Here, they can upload images and personalize their information.

3.4. Company Profile Approval

3.4.1. By creating a company profile on the EDI Jobs platform, you represent and warrant that your company upholds our standards of social responsibility and ethics, particularly in promoting equity, diversity, and inclusion (EDI). These standards encompass:

    • Commitment to Equity, Diversity, and Inclusion: All companies using the EDI Jobs platform commit to fostering equity, diversity, and inclusion throughout their organization, including in hiring practices, workplace culture, and policies.
    • Non-Discrimination: Companies using EDI Jobs pledge not to discriminate against job seekers based on factors such as race, ethnicity, gender identity, sexual orientation, religion, age, or any other protected characteristic.
    • Fair Hiring Practices: Companies agree to adhere to all relevant laws and regulations regarding hiring, ensuring fair and inclusive hiring processes that provide equal opportunities to all candidates, regardless of background.
    • Ethical Conduct: Companies utilizing EDI Jobs agree to conduct themselves ethically and responsibly in all aspects of their operations, including hiring practices and workplace culture. This includes refraining from any actions that may disadvantage job seekers or perpetuate inequities.
    • Termination of Use: EDI Jobs reserves the right to terminate the use of its platform by any company found to be in violation of this agreement or engaged in unethical or discriminatory practices.

3.4.2. By utilizing the EDI Jobs platform, companies affirm their commitment to these principles and undertake to promote equity, diversity, and inclusion across their organization. We retain the right to review, approve, or deny any company profile and to revoke approval for any previously approved profile if it is later found to contravene these standards.

3.4.3. Company Profile Data Usage:

By creating a company profile on the Website, you grant the Company a non-exclusive, irrevocable, royalty-free worldwide license to use your company name and logo for unlimited usage in external communication related to the Website and its services. This may include, but is not limited to, website listings, marketing materials, and social media promotion. You retain all ownership rights to your company name and logo.

3.4.4. Additional Services for Companies

3.4.4.1. In addition to basic account features, EDI Jobs offers supplementary services for companies with additional fees, including:

    • Creating customized company profiles.
    • Making job postings.
    • Offering a language editing service to ensure job postings meet EDI standards.

3.4.4.2. Companies have the option to use the inclusive language tool at no additional cost to ensure their job postings meet EDI standards.

3.5. Additional Features for Candidates: Upon creating a candidate account, users can customize their job preferences to receive notifications tailored to their interests and qualifications.

3.6. Messaging: Account holders can make use of the platform’s direct messaging system.

4. Posting Jobs

4.1. To post jobs, employers need to have a company account and an active plan. Plans are described on the pricing page for job postings and can be purchased individually or as part of a package.

4.2. Job postings on EDI Jobs can be categorized as either standard, featured, or featured with maximum promotion service.

  • Standard Job Postings are website only promotion and will be displayed only on the platform EDI Jobs
  • Featured Job Postings will be highlighted as Featured on the platform EDI Jobs
  • Featured job postings with maximum promotion service, include being featured in the newsletter sent to subscribers, social media promotion, and multiposting on other job boards with EDI branding.

4.3. Employers have the option to directly link their job postings to their employer’s job board or ATS via URL.

4.4. Employers have the option to use an XML interface for job postings, provided they supply a correctly formatted file. EDI Jobs will assist with setup and support as needed.

4.5. Imports via XML interface are scheduled to occur every 30 days.

4.6. Additionally, if employers choose XML, they can utilize the dashboard as well to post jobs. However, each job post will be counted towards their usage.

5. Form Submission Process

5.1. For certain activities on the EDI Jobs platform, such as subscribing to newsletter, publishing articles, news, events, jobs, obtaining an EDI Badge, or requesting social media promotion, users are required to fill out a form provided by the platform.

5.2. The forms are designed to collect necessary information from users to facilitate the requested activity effectively.

5.3. Upon accessing the relevant feature on the platform, users will be prompted to complete the corresponding form with accurate and complete details.

5.4. Users are responsible for ensuring the accuracy and authenticity of the information provided in the forms.

5.5. Submission of the form constitutes consent for the platform to process the provided information for the intended purpose.

5.6. The platform reserves the right to verify the information provided in the forms and may request additional details or documentation if necessary.

5.7. Users will be notified of the status of their form submission via email.

5.8. The platform aims to process form submissions in a timely manner, but the processing time may vary depending on the nature of the request and platform workload.

6. Intellectual Property

6.1. All intellectual property rights related to the content and materials available on the EDI Jobs platform, including but not limited to trademarks, copyrights, patents, trade secrets, and any other proprietary rights, are owned by the Operator or its licensors.

6.2. Users acknowledge and agree that the educational videos, quizzes, job postings, articles, and other content available on the platform are protected by applicable intellectual property laws.

6.3. The educational videos and quizzes provided on the platform are the exclusive property of EDI Jobs. Users are strictly prohibited from copying, downloading, or distributing these materials without prior written consent from the Operator.

6.4. Job postings on the platform may contain logos, titles, and descriptions provided by employers. Users acknowledge that these elements, along with any associated content, are displayed on the platform and may be utilized for social media multiposting and other promotional activities to enhance exposure for job postings.

6.5. Articles published on the platform are either created by EDI Jobs or provided by partners whose content aligns with EDI principles. Users agree to respect the intellectual property rights of EDI Jobs and its partners and may not reproduce, distribute, or modify these articles without authorization.

6.6. The EDI AI tools provided for employers and candidates are proprietary technologies developed by EDI Jobs to facilitate the implementation of inclusive language practices and support the creation of relevant content. Users may access and use these tools solely for their intended purposes on the platform.

6.7. The EDI Commitment badge is a symbol of organizations’ dedication to EDI principles and is strictly prohibited from use unless provided by EDI Jobs. Unauthorized use of the badge is prohibited and may result in legal action.

6.8. Users are encouraged to report any suspected infringement of intellectual property rights on the platform to the Operator for prompt investigation and resolution.

7. Privacy Policy

7.1. By using the services provided by the EDI Jobs Platform, users agree to be bound by the terms outlined in our Privacy Policy. Our Privacy Policy governs the collection, processing, and sharing of personal data.

7.3. By utilizing the services, users agree to the collection, processing, and sharing of their personal data as outlined in the Privacy Policy. It’s important to note that we do not share data without explicit consent.

7.4. We may review and update these Terms, including the Privacy Policy, periodically. Any changes will be communicated to users, and continued use of the services after the changes constitute acceptance of the updated terms.

7.5. While efforts are made to protect user privacy and data, we cannot guarantee absolute security. Users should take precautions when sharing personal information online.

8. Payment Terms

8.1. The payment for job posting services is as follows: When creating a company account, users can access, in their dashboard or on the pricing page, a pricing table that processes payment via Stripe automatically. The Website uses Stripe as its payment processing partner to securely process job posting fees. By using the Website to post job listings, you agree to be bound by Stripe’s terms of service and privacy policy.

8.1.1. If a user prefers to pay via invoice, they can send an email to [email protected] or use the form on the website for quotes and invoices available at https://edijobs.io/quote-invoice/. The payment due date is immediate upon receipt of the invoice and extends to within 14 days.

8.1.2. Activation of the account and publishing of job postings will occur after payment has been received. Job postings will only be made visible on the Website after receipt of payment for the selected job post plan. We reserve the right to remove job postings at any time if payment is not received or if the job posting violates our terms and conditions.

8.1.3. Refund requests must be made within 14 days of payment. Refunds are applicable only for posting packages. However, please note that the posting fee is generally non-refundable. Refunds, if applicable, will be subject to deduction of all relevant expenses incurred for job postings and service charges. These deductions may vary depending on the service provided.

8.1.4. Termination is unnecessary since the active plan naturally expires based on its designated duration.

8.2. Payment Process for the EDI Commitment Badge: Utilization of the specified form available on the website. Upon receipt of payment, we will promptly dispatch the badge in PNG, JPEG, and SVG formats along with a hyperlink to the self-assessment checklist.

8.3. Payment for Social Media Services: Utilization of the designated form on the website. The remaining details are contingent upon the agreement. Payment is due within 14 days after receipt of the invoice. Social media services require advance payment.

9. Communication

You agree to receive communications from us, including but not limited to email related to your use of the Website. You may opt out of receiving certain types of communications by following the unsubscribe instructions included in each message.

10. Third Party Links

The Website may contain links to third-party websites or resources. We have no control over the content, products, or services offered by these third-party websites, and you acknowledge and agree that we are not responsible for the availability or accuracy of such websites or resources. You also acknowledge and agree that we shall not be liable for any damage or loss caused or alleged to be caused by or in connection with your use of or reliance on any such content, goods, or services available through any such website or resource.

11. Usage of Third-Party APIs

The Website may use APIs provided by third-party websites, such as social media platforms like LinkedIn, to enhance the user experience. By using the Website, you grant us permission to access and use your information from these third-party APIs in accordance with their terms of use and privacy policies. You acknowledge and agree that we shall not be liable for any damage or loss caused or alleged to be caused by or in connection with the use or access of such third-party APIs.

The Website uses cookies to enhance your experience and gather information about your use of the site. By using the Website, you consent to the use of cookies in accordance with our privacy policy.

You are obligated to indemnify and keep us free from any claims, losses, expenses, and costs, including reasonable attorney’s fees, that may result from your use of the Website, your violation of these Terms, or your infringement of any third party’s rights.

These Terms constitute the entire agreement between you and us with respect to your use of the Website. We reserve the right to modify these Terms at any time without prior notice. Your continued use of the Website after any such modification constitutes your acceptance of the new terms. If it is determined that any portion of these Terms is invalid or unenforceable, that specific part will be removed and the remaining provisions will be upheld. These Terms shall be governed by and construed in accordance with the laws of the Federal Republic of Germany, without giving effect to any principles of conflicts of law. You agree to submit to the exclusive jurisdiction of the courts located in Berlin, Germany to resolve any dispute arising out of or relating to these Terms or your use of the Website.

18.2. Disclaimer of Warranty for Job Post Success

The Company does not guarantee the success of any job posting in attracting qualified candidates. While the Platform offers tools and features to support job posting, the outcome of these postings depends on various factors beyond our control.
